  1. Our organisation is Tranquillo Wines Pty Ltd trading as grandcruwines.com.au, ABN 264 833 729 23. The purchase of alcohol made through grandcruwines.com.au is performed under the following Victorian Liquor Licence No. 31957577; 395 Wattletree Road, Malvern East Victoria 3145. 
    By visiting and using grandcruwines.com.au you accept and agree to be bound by the following website Terms and Conditions. If you do not accept this, please do not use this site.
  2. Purchasing via grandcruwines.com.au
    It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years.
    If you purchase products via grandcruwines.com.au you certify to us that:
    you are over the age of 18 years; and any person that you obtain the products for, or supply the products to, is over the age of 18 years.
  3. Where a particular wine vintage is not available, another vintage may be offered. Vintages are subject to change without notice. Please note, label images may differ to the label on the wine supplied.
    If products ordered by you are not in stock, grandcruwines.com.au will advise you and offer to you a comparable product of equal or greater value.
    You are not permitted to order any products for resale to a third party. grandcruwines.com.au reserves the right to accept or reject any offer you make us, for any reason, including but not limited to if the products requested are not available, payment not being processed successfully, we suspect your order is for commercial purposes, there is the possibility of fraud or there is an error in the price or description of the product you want to buy. We will immediately notify you of this by email or phone, using the e-mail address or phone number(s) provided. We will refund the monies paid using the original method received.
    Each offer you make to us and accepted by us creates a separate and binding agreement between you and us for the supply of the relevant products.
  4. All specials, promotions, clearances, offers and discounted items advertised on grandcruwines.com.au are available only while stocks last unless otherwise advertised.
  5. All prices are in Australian dollars and are inclusive of GST. The total of your order and your delivery fees are estimated until delivery details are provided in the checkout. Promotional offers and prices are as stated, with no further discounts available. You agree to pay the price of the products specified on the website or quoted to you by our Customer Service agents over the phone. You also agree to pay the delivery and handling fee (if applicable) in respect of each order and all taxes, including goods and services tax. We reserve the right to vary prices without notice. The price payable for the product is the price applicable on the date the products are confirmed as ordered. We endeavour to ensure that all prices displayed are correct but occasionally an error may occur. If we discover a pricing error we will notify you.
  6. AMEX, MasterCard, and Visa card are accepted as methods of payment for orders. Cheques and money orders are not accepted methods of payment. Payment must be cleared before products are dispatched.
    Risk and title of the order passes to you upon delivery of the order to the delivery address.
  7. eGift Cards - Gift Cards cannot be used to purchase Gift Cards. Not valid for use on promotional giveaway items. Valid for purchases through grandcruwines.com.au only. Gift cards must be redeemed in one purchase. Recipient details including name, email and mobile phone contact will be required to activate the Gift Card. Valid for three years from date of purchase.
  8. We collect and use your personal information in accordance with our Privacy Policy.
  9. We may change these website Terms and Conditions at any time without notice. Please review these website Terms and Conditions regularly to ensure you are aware of any changes made.
  10. Material from the site cannot be reproduced without the express written permission of the owners of this site.
  11. While the information published on this website is believed to be accurate and current, it is provided in good faith on an ‘as is’ basis grandcruwines.com.au, its directors, officers or employees make no representation or warranty as to the reliability, accuracy or completeness of the information contained on the website and do not accept any responsibility arising in any way (including negligence) for errors in, or omissions from, the information contained in the website. We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate.
    To the extent (if any) that the content of the website does not satisfy the laws of a country other than Australia, it is not directed to persons in those countries and they should not use the website.
  12. Liability and general matters
    We are not liable to you for any consequential, indirect, special, punitive, remote or incidental damages or for any loss of profit, loss of data, loss of goodwill, loss of business, loss of opportunity, increased financing costs, or any failure to realise anticipated savings or any type of commercial or economic loss. All goods supplied to you come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

    You may also be entitled to remedies that cannot be excluded under the Australian Consumer Law if any services supplied to you fail to meet a consumer guarantee under the Australian Consumer Law. Nothing in this document excludes, restricts or modifies any condition, guarantee, warranty, right or liability protected by law to the extent that such exclusion, restriction or modification would render this document or any provision of this document void, illegal or unenforceable. Save for in relation to claims you make under the Australian Consumer Law, the maximum amount we will be liable to you in connection with any claim (or claims) you make in relation to your use of our sites and buying products from us is limited in aggregate to the amounts you have paid us for the provision of goods or services.
    Our liability to you for loss or damage of any kind arising out of this agreement or in connection with the relationship established by it is reduced to the extent (if any) that you cause or contribute to the loss or damage. This reduction applies whether our liability is in contract, tort (including negligence), under any statute or otherwise.

    You own the intellectual property rights in the data you provide us. We own (or have rights to use) all other intellectual property existing in and developed in connection with this site. You have no rights to use in any way any of our intellectual property including but not limited to using, copying, embedding (in another website) any design, text, marks and graphics appearing on our site. Each party submits to the non-exclusive jurisdiction of the courts of that place. Any rights or remedies to which you are entitled under the Australian Consumer Law arise independently of these terms and conditions and the jurisdictional selection provision above does not apply to any claim you may have under the Australian Consumer Law.
